Texas Grand Jury Indicts Netflix For Promotion Of Lewd Material

A Tyler County grand jury has indicted Netflix Inc. in connection with a controversial film titled ‘Cuties’.  The grand jury indicted the streaming service on a charge of promotion of lewd visual material depicting a child.

Representative. Matt Schaefer, R-Tyler, tweeted a copy of the indictment today.

“Netflix indicted by grand jury in Tyler Co, for promoting material in Cuties film which depicts lewd exhibition of pubic area of a clothed or partially clothed child who was younger than 18 yrs of age which appears to the prurient interest in sex,” Schaefer said in his tweet.

The text of the indictment states that Netflix knowingly promotes “visual material which depicts the lewd exhibition of the genitals or pubic area of a clothed or partially clothed child who was younger than 18 years of age at the time the visual material was created, which appeals to the prurient interest in sex and has no serious literary, artistic, political, or scientific value … ”

The movie sparked controversy when it debuted the French film that follows an 11-year-old girl who joins a twerking dance group.  The controversay escalated when viewers saw a 11-year-old character named Amy pull down her underwear and photographs her genitals to post on social media.  The scene preceding it shows Amy trying to seduce an older male to get out of trouble for stealing his cell phone.

Senator Ted Cruz called for the Department of Justice involvement,

“The film routinely fetishizes and sexualizes these pre-adolescent girls as they perform dances simulating sexual conduct in revealing clothing, including at least one scene with partial child nudity. These scenes in and of themselves are harmful. And it is likely that the filming of this movie created even more explicit and abusive scenes, and that pedophiles across the world in the future will manipulate and imitate this film in abusive ways…Although the First Amendment provides vigorous protection for artistic expression, it does not allow individuals or for-profit corporations to produce or distribute child pornography. “

A court date has not been announced yet.
